    By accessing or using somarae ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors and registered members.

    2. Description of Service

    somarae is a digital wellness platform that provides AI-guided somatic micro-practices, voice and chat sessions with our AI guide ("Soma"), menstrual cycle and menopause tracking, journaling, an emotional wellness dashboard, a private community, and an educational learn hub. The Service is designed to support your wellness journey and help you understand your body's patterns.

    2.5 AI-Generated Content Disclaimer

    2.5.1 Accuracy Limitations

    somarae uses artificial intelligence, including voice AI (Soma AI) and text-based AI systems, to provide personalized wellness guidance and insights. While we strive to provide helpful and accurate information, AI-generated content may contain inaccuracies, errors, or limitations. You should independently verify any information or recommendations before acting on them.

    2.5.2 No Guarantee of Results

    AI-generated insights, patterns, and recommendations are based on the data you provide and algorithmic analysis. We do not guarantee the accuracy, completeness, or usefulness of any AI output. Your experience and results may vary.

    2.5.3 User Responsibility

    You acknowledge that AI is a tool to assist your wellness journey, not a replacement for your own judgment, professional advice, or medical care. You are responsible for evaluating and deciding how to use any AI-generated content.

    3. Important Health Disclaimer

    3.1 Not Medical Advice

    somarae is NOT a medical service or mental health treatment. The Service provides wellness support and educational information only. It is not a substitute for professional medical advice, diagnosis, or treatment. Our AI guide (Soma AI) is not a licensed therapist, counselor, or healthcare provider. Conversations with Soma AI should not be considered therapy or medical consultation.

    Always consult with qualified healthcare professionals for medical concerns, including reproductive health, mental health conditions, and chronic stress.

    3.2 Crisis Resources

    If you are experiencing a mental health crisis, suicidal thoughts, or a medical emergency, please contact emergency services (911), a crisis hotline, or seek immediate professional help. somarae is not equipped to handle emergencies.

    3.3 Cycle Tracking Limitations

    Cycle tracking features are for personal awareness only and should not be used as a contraceptive method, for fertility planning, or for medical decision-making. Predictions are estimates based on the data you provide and may not be accurate.

    4. User Accounts

    4.1 Eligibility

    You must be at least 18 years old to create an account and use the Service.

    4.2 Account Security

    You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You may not share your account or allow others to access the Service using your credentials.

    4.3 Account Information

    You agree to provide accurate, current, and complete information during registration and to update your information as needed.

    5. Acceptable Use

    5.1 Prohibited Conduct

    You agree NOT to:

    • Use the Service for any illegal or unauthorized purpose
    • Harass, abuse, or harm other users in the community
    • Post content that is hateful, discriminatory, or promotes violence
    • Share sexually explicit or inappropriate content
    • Impersonate others or misrepresent your identity
    • Attempt to gain unauthorized access to other accounts or our systems
    • Use automated systems (bots) to access the Service
    • Interfere with or disrupt the Service or servers
    • Collect user data without consent
    • Use the Service to promote commercial products or services without permission

    5.2 User Responsibilities

    You are solely responsible for your conduct and any content you submit, post, or display on the Service. You agree to use the Service in compliance with all applicable laws and regulations.

    6. Community Guidelines

    Our community is built on mutual support and respect. When participating in community features, you agree to:

    • Be kind, supportive, and respectful to all community members
    • Share only your own experiences and perspectives
    • Avoid giving medical advice or claiming expertise you don't have
    • Respect others' privacy and anonymity choices
    • Report concerning content or behavior to our moderation team
    • Remember that community sharing is not a substitute for professional support

    We reserve the right to remove content and suspend accounts that violate these guidelines.

    7. Content Ownership

    7.1 Your Content

    You retain ownership of all content you create (posts, reflections, session notes, etc.).

    7.2 License to somarae

    By posting content to the community, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content in connection with operating the Service.

    7.3 Our Content

    All other content, including our AI, educational materials, designs, trademarks, and code, is owned by somarae and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

    7.4 Feedback

    Any suggestions, ideas, or feedback you provide may be used by us without compensation or attribution to improve the Service.

    8. Privacy

    Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information, including sensitive health data like menstrual cycle information and emotional wellness data.

    8.5 Subscriptions, Billing & Refunds

    8.5.1 Free Trial

    New users may be offered a 7-day free trial. Starting a trial may require a valid payment method. Unless you cancel before the trial ends, your trial will automatically convert to a paid subscription at the then-current price.

    8.5.2 Subscription Plans & Auto-Renewal

    Monthly and annual subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. By subscribing, you authorize us and our payment processors to charge your payment method for each renewal.

    8.5.3 Billing & Payment Processors

    Web purchases are processed by Stripe. Mobile in-app purchases are processed by the Apple App Store or Google Play and are governed by their respective terms and billing policies. Applicable taxes may be added based on your jurisdiction.

    8.5.4 Cancellation

    You may cancel your subscription at any time from Profile → Subscription (or, for mobile in-app purchases, through your Apple App Store or Google Play account). Cancellation stops future renewals; your access continues until the end of the current paid billing period.

    8.5.5 No Refunds and No Partial Refunds

    All payments are final and non-refundable. We do not issue refunds or partial refunds for any unused portion of a subscription period. This includes, without limitation: mid-cycle cancellations, downgrades, account suspensions or terminations for violations of these Terms, periods of non-use, forgotten cancellations, accidental renewals, or any unused days, weeks, or months remaining on a monthly or annual plan. Annual plans are not pro-rated. For purchases made through the Apple App Store or Google Play, all refund requests are handled solely by those platforms under their own policies. Nothing in this section limits any non-waivable statutory refund or cancellation rights you may have under applicable consumer-protection laws (for example, certain rights available to consumers in the EU and UK).

    8.5.6 Retention Offers

    From time to time we may offer alternatives to cancellation, such as a temporary pause or a discount on future billing periods. Any such offer is provided at our sole discretion, may be modified or withdrawn at any time, and does not create any entitlement to refunds or partial refunds.

    8.5.7 Price Changes

    We may change subscription prices from time to time. We will provide reasonable advance notice (typically at least 30 days) before a price change takes effect for your next renewal. Continued use of the Service after a price change becomes effective constitutes acceptance of the new price.

    8.5.8 Chargebacks

    If you believe a charge is incorrect, please contact us at support@somarae.co before disputing it with your bank or card issuer. Initiating a chargeback without first attempting to resolve the issue with us may result in immediate suspension or termination of your account.

    9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW:

    • The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
    • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
    • We are not responsible for any health outcomes, decisions, or consequences based on information or features provided by the Service.
    • Our total liability shall not exceed the amount you paid for the Service in the past 12 months (or $50 if you haven't paid anything).

    10. Indemnification

    You agree to indemnify, defend, and hold harmless somarae, its officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

    11. Account Termination

    11.1 Termination by You

    You may delete your account at any time through your profile settings.

    11.2 Termination by Us

    We may suspend or terminate your account if you violate these Terms, engage in behavior that harms other users or the Service, or for any other reason at our sole discretion with or without notice.

    11.3 Effect of Termination

    Upon termination, your right to use the Service will immediately cease. Your data will be handled according to our Privacy Policy. Sections of these Terms that by their nature should survive termination will remain in effect.

    12. Dispute Resolution & Arbitration

    12.1 Informal Resolution

    Before filing any formal dispute, you agree to first contact us at support@somarae.co to attempt to resolve the dispute informally. We will try to resolve your concerns within 30 days.

    12.2 Binding Arbitration

    If we cannot resolve the dispute informally, you and somarae agree to resolve any claims through final and binding arbitration, except as set forth below. The arbitration will be conducted by JAMS under its Streamlined Arbitration Rules.

    12.3 Class Action Waiver

    You agree to resolve disputes only on an individual basis and waive the right to participate in class actions, class arbitrations, or representative actions.

    12.4 Opt-Out

    You may opt out of the arbitration agreement by sending written notice to support@somarae.co within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

    13. Electronic Communications

    By using the Service, you consent to receive electronic communications from us, including emails, push notifications, and in-app messages. These communications may include service announcements, administrative messages, and promotional content. You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

    14. Third-Party Links

    The Service may contain links to third-party websites, services, or resources. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party sites are solely between you and that third party. We encourage you to review the terms and privacy policies of any third-party sites you visit.

    14.5 Third-Party Services

    The Service integrates with the following third-party services to provide its features. By using the Service, you acknowledge and agree to the use of these services:

    • ElevenLabs: Provides voice AI technology for Soma AI voice sessions. Voice interactions are processed in real-time. ElevenLabs' use of data is governed by their Terms of Service.
    • OpenAI: Powers AI-generated wellness insights and pattern analysis. Your aggregated session data may be processed to generate personalized recommendations. Your data is not used to train AI models. Use is governed by OpenAI's Terms of Use.
    • Supabase: Provides database hosting, authentication, and backend services. Data is stored securely with SOC 2 Type II compliance.

    15. Service Availability

    We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

    16. Changes to Terms

    We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms, updating the "Last updated" date, and/or sending you an email notification. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

    17. Governing Law

    These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in California.

    18. Severability

    If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

    19. Entire Agreement

    These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and somarae regarding your use of the Service. These Terms supersede any prior agreements or understandings.

    20. Waiver

    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by somarae.

    21. Force Majeure

    We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, internet or telecommunications failures, or power outages.
